Terms of Agreement
The terms of this agreement will commence on the date agreed by both parties and will be on an as-need basis until the agreement is terminated by either party, as provided hereunder.
Services Requested: OvalCare NG will provide the service (“Services”) requested and agreed upon by both parties. The preferred day, time and duration of services will be mutually agreed upon by the Client’s family, or stated representative and OvalCare NG.
OvalCare NG will provide the following domiciliary services according to the schedule below:
- Companionship and emotional support
- Minimal housekeeping
- Light Shopping
- Medication handling and supervision
- Assistance with daily activities
- Accompanying on appointments, visits to hospitals
- Support getting out and about
Schedule
- Live-in care
Live-in care assumes the caregivers get between 5-8 hours’ sleep per night, with an exception of two or three ‘disturbances’ over a one-month period.
If the caregiver is required to be awake throughout the night, then both the hourly rate (24-hour care) and overtime rule will be applied by OvalCareNg.
Rates, Fees & Deposits: OvalCare NG will provide the services at the agreed upon rates.
Live-in rates noted above assume that the caregiver’s food comes from the family pantry. If for any reason this is not practical, there will be an additional charge to be agreed upon for each of the caregivers to supply his/her own food.
If multiple service types outside of the agreed contract are being introduced, or if the service requested changes, OvalCare NG reserves the right to change the rates accordingly.
In addition, rates for services provided by OvalCare NG are subject to review from time to time. The Client’s family will be provided with a minimum of four-week advance notice prior to the increase being implemented.
In exceptional cases where the client requires the services of a given caregiver, whilst the caregiver is scheduled to be off duty, OvalCare NG assumes the client recognizes, also accepting that the caregiver will accrue overtime pay to be agreed upon, if the caregiver is willing to work the required overtime.
Deposits. You are expected to make a full payment deposit, a month’s service charge upon execution of this contract and before the start of our services.
The outstanding balance is expected to be settled on the last day of the month. If you request an increase in care services, the deposit will be increased proportionately.
Payment and Overdue Accounts. Fees for services rendered are payable at the end of a 30-day period, into an account specified by OvalCare NG. It is OvalCare NG’s policy not to accept cheques endorsed over to OvalCare NG.
All payments must be remitted to the account(s) provided by OvalCare NG; DIRECT CARE WORKERS are not permitted to accept payments. An account is considered overdue outside the 30 days’ payment period.
We reserve the right to discontinue providing services until the account is paid in full, including any additional charges.
Cancellations. Cancellations may be made up to 24 hours in advance of a scheduled visit without charge. We reserve the right to charge for a scheduled visit if sufficient notice is not given (less than 24 hours).
If a referred caregiver fails to arrive at the care recipient’s home, we will make every effort to find a replacement as quickly as possible (latest within 48 hours).
If a replacement is not found or if the caregiver alters the predetermined weekly or monthly schedule in some way, we will adjust the amount that the Client’s family is billed accordingly.
Termination. Either “client “or “Agency “may terminate this agreement upon two (2) calendar-weeks written notice to the other party. If either party terminates this agreement, all fees due at time of termination will be payable by the Client’s family immediately.
We will immediately refund any prepaid fees.
An exception to the two-week notice provision would include:
- When care needs undergoes a change which necessitates transfer to a higher level of care.
- When there is documented non-compliance of the Care Plan or Service Agreement (including, non-payment of justified charges, unaligned duties not related to care).
- When the activities or circumstances in the home jeopardizes the welfare and safety of the caregiver. Client or client’s representative shall have the right to appeal the discharge decision during the two-week notice period and will be notified of this in the discharge statement. The Appeal panel will be led by the Director of Care Services and include both the Supervisor and Caregiver. The panel will review the client’s file with the client or clients’ representative. The Director of Care Services decision is final.
Housekeeping Defined: The caregiver is required to provide a general housekeeping service. Typical housekeeping tasks to be provided by the caregiver would include:
- Tidying up of rooms in which the care recipient spends his/her time (bedroom, living room, kitchen),
- Washing dishes after meals (wiping spills on sink or floor, “spot cleaning”),
- Sweeping kitchen floor when needed, passing the vacuum in rooms used by care recipients.
- Tidying bathrooms after use by care recipient (rinsing tub or shower after use, wiping spills on sink or floor) and light laundry of SOLELY client’s/care recipient’s clothes.
- House chores or washing of clothes for other family members outside of the care recipient is NOT allowed as this impedes on the quality of care and time available for adequate attention to the client.
Supplies and Equipment. The Client’s family is responsible for providing all supplies (Cleaning, personal care items such as latex gloves needed for the safe execution of any kind of personal care) and equipment which may be necessary in the provision of services.
Extra charges will apply if OvalCare NG provides the supplies and/or equipment.
Monitoring and Follow-up: Service(s) requests/needs will be reviewed by the Supervisor at least every 60 days or as needed, and that the service(s) may be changed according to the client’s needs, wants, or wishes, after careful consideration by the agency.
